AOP Information - Voluntarily Establish Paternity
The Acknowledgment of Paternity (AOP) Affidavit is a legal form parents complete to add the biological father's name to the child's birth certificate. By signing the form, parents establish paternity for their child, giving the father legal rights.
Acknowledgment of Paternity Affidavit
There are two types of AOP forms:
2-Party AOP
For unmarried parents.
3-Party AOP
For married or recently divorced parents (within 300 days of birth) where a third-party biological father is involved. Requires agreement of all parties and DNA-based paternity testing showing at least 99.9% probability.
Where to Complete an AOP
At the Hospital at the Time of Birth
AOPs completed in the hospital are free and the quickest way to establish paternity. Hospital staff assist with notarization and filing.
After Leaving the Hospital
Parents may complete an AOP at:
- Central Vital Records office in New Orleans
- Local child support office
- By mail
A 3-party AOP can only be completed at Central Vital Records or by mail.
Important Information Before Signing
If You Are Not Married
Use the 2-party AOP if the mother was not married at birth or within 300 days before birth.
If You Are Married or Recently Divorced
Use the 3-party AOP if the mother was married to someone other than the biological father at birth or divorced less than 300 days before birth.
Requirements to Complete an AOP
- Picture ID
- Parents’ full names
- Social Security numbers (or “None”)
- Current addresses
- Dates of birth
- Places of birth
- Employment and insurance information
- Certified child’s birth certificate
- Licensed notary with witnesses
Additional 3-Party Requirements:
- Husband/ex-husband information
- Certified DNA test with 99.9% probability
